MEETING WITH HON'BLE MR. JUSTICE G.P. MATHUR, ACTING CHAIRPERSON, NATIONAL HUMAN RIGHTS COMMISSION, NEW DELHI REGARDING REPRESENTATION DATED 2.12.20009 RELATING TO JUVENILES IN JAILS

The Forum had made a representation to the National Human Rights Commission against lodging of juveniles in jails. Pursuant thereto NHRC issued notice on 24.8.2006 to the Inspector Generals of Prisons of all the States/Union Territories to carry out necessary survey to ascertain whether any persons below the age of 18 years is detained in any of the jails within their respective jurisdiction. As per reports received by NHRC large number of juveniles were lodged in jails in various States. Accordingly, LAF has made a representation dated 2.12.2009 requesting that NHRC may direct that all these Juveniles be immediately released from the jails and sent to Observation Homes and State Government to award suitable compensation to the Juvenile lodged in jails depending on the period spent by each one of them in jails.

Mr. Vijay Hansaria, President, LAF and Mr. Jayesh K.U., Joint Secretary, LAF met Hon'ble Mr. Justice G.P. Mathur, Acting Chairperson, National Human Rights Commission at New Delhi on 18.1.2010. LAF emphasized that there is a statutory bar under the Juvenile Justice Act against lodging of juvenile in jails and requested the Hon'ble Chairperson to take immediate steps by calling upon the State Governments particularly the State of U.P. (where as many as 237 juveniles are kept in jails as per the report sent by the IGP, Prison, U.P.) to shift the juveniles from the jails to the Observation Homes or at least segregate the juveniles from the hardened criminals in the jails till such time juveniles are shifted out of the jails. Hon'ble Justice Mathur assured to take appropriate action in the matter.
