LOK ADALATS IN ASSAM JAILS

Legal Assistance Forum in association with Assam State Legal Services Authority organised Lok Adalats inside Central Jails of Tezpur, Jorhat and Nagaon for the first time in Assam. In these Lok Adalats number of cases were amicably settled/decided which resulted release of undertrials languishing for long period for petty offences. Hon'ble Mr.Justice P.G. Agarwal of Gauhati High Court attended the Lok Adalat at Tezpur and Hon'ble Mr. Justice A.H. Saikia of Gauhati High Court attended the Lok Adalats at Jorhat and Nagaon.

The Forum’s team comprised of Shri Vijay Hansaria, President, Prof. (Dr.) Usha Tandon, Vice President, Mr.P.I.Jose, Secretary, Mr.K.S.Bhati, Treasurer, Ms Minakshi Sarma, Jt.Secretary, Mr.Anupam Mishra, Ms Sneha Kalita, members executive committee, all Advocates practicing at Supreme Court of India, Delhi; and Ms. Mary Gogoi, Ms. Minerva Borthakur, Advocates, Gauhati High Court.

Lok Adalat at Tezpur on 20th June 2006
The Lok Adalat was presided over by Hon'ble Mr.Justice P.G. Agarwal, Judge Gauhati High Court. Many judicial officer including Mr. C.R.Sharma, District & Session Judge were present.
 
Members of the Tezpur Bar Association including Mr. Priyanku Sundi, Advocate and Mr. Ansari Imtiaz, Advocate were also present.
It as the first Lok Adalat ever held inside Jail premises in Assam. In the Lok Adalat many cases were amicably settled/decided decided on the basis of compromise/ plea bargaining resulting in the release of accused persons involved in petty offences. Members of the Forum took active part by appearing on behalf of the accused and also persuaded the complainants for amicable settlements. Wherever offences were not serious in nature, the judicial officers who heard the matters accepted the plea of the LAF members and released the accused on period undergone.
Cases which were not settled for where accused persons did not have lawyers to represent themselves before court, LAF arranged lawyers for them without any charges. In one of the cases filed by one Mstt. Alekjan Khatun for cheating and criminal intimidation under sections 417 and 506 IPC against Mr. Joinaluddin, the accused and the complainant agreed to compromise on the following terms and conditions:
  1. Accused Joinaluddin agrees to marry the complainant Alekjan Khatun within two weeks from today.
  2. Accused acknowledge and accepted the parentage of the son Ashiqual Islam born to the complainant through the accused.
  3. Accused agrees to maintain and provide shelter for the complainant and her son.

It is important to noted that because of compromise minor child Ashiqual Islam born to the complainant through the accused got parentage which will go a long way in the future of the child.

The Forum also arranged food for all the jail inmates with the help of Mr. Deepak Tribrewal and Mr. M. Jhanwar, socially committed local businessman.

 

Lok Adalat at Jorhat on 22nd June 2006
The Lok Adalat was presided over by Hon'ble Mr.Justice A.H. Saikia, Judge Gauhati High Court. Many judicial officer including Mr. Tarun Phukan, District & Session Judge were present.

Members of the Jorhat Bar Association including Mr. Manik Khaund President, Jorhat Bar Association, Mr. Dhiraj Bordoloi ,Mr. Simanta Kr. Borthakur, Mr. Subir Ranjan Bharadwaja, Ms. Meera Baruah and Ms. Rupali Rai Baruah, Advocates were present.

It as the first Lok Adalat ever held inside the Jorhat Jail premises. In the Lok Adalat many cases were amicably settled/decided decided on the basis of compromise/ plea bargaining resulting in the release of accused persons involved in petty offences. Members of the Forum took active part by appearing on behalf of the accused and also persuaded the complainants for amicable settlements. Wherever offences were not serious in nature, the judicial officers who heard the matters accepted the plea of the LAF members and released the accused on period undergone.

In the Lok Adalat many cases were amicably settled/decided on the basis of compromise/ plea bargaining resulting in the release of number of accused persons involved in petty offences.

The Forum also arranged food for all the jail inmates with the help of Jorhat Rotary Club.
Lok Adalat at Nagaon on 23rd June 2006
The Lok Adalat was presided over by Hon'ble Mr.Justice A.H. Saikia, Judge Gauhati High Court. Many judicial officer including Mr. A.C. Upadhaya, District & Session Judge were present.

Members of the Nagoan Bar Association including Mr. Gangabalav, Secretary , Nagaon Bar Association, Mr. Nasiruddin Ahmad, Mr. Jaikishan Bajaj, Mr. Pankaj Agarwal, Advocates were present.
In the Lok Adalat many cases were amicably settled/decided decided on the basis of compromise/ plea bargaining resulting in the release of accused persons involved in petty offences. Members of the Forum took active part by appearing on behalf of the accused and also persuaded the complainants for amicable settlements. Wherever offences were not serious in nature, the judicial officers who heard the matters accepted the plea of the LAF members and released the accused on period undergone.
The Forum also arranged food for all the jail inmates with the help of Nagaon Marwari Mahila Manch represented by Mrs. Lata Agarwal and Mrs. Usha Bajaj among others.
